Shareholder Joseph R. Englander presented in the Strafford live webinar, "Trademark Registration: Overcoming Failure-to-Function Refusals, Meeting Use and Distinctiveness Requirements" on Wednesday, April 22, 2020.

This CLE live webinar guided IP counsel on avoiding or overcoming potential roadblocks to trademark registration for failure to function under the Lanham Act. The panel discussed the use and distinctiveness requirements and how the USPTO and courts have treated the issue. They also provided best practices for overcoming failure-to-function refusals. There was also a live Q&A after the presentation for all participants.

Shareholder Joseph Englander will be moderating a panel on "Potential Health Risks & Regulatory Hurdles Associated with Cannabis & Its Concentrates" at the American Bar Association 2020 Environmental & Energy, Mass Torts, and Products Liability Litigation Committees' Joint Regional CLE Program. The panel will be discussing the findings and standing questions regarding the potential toxicological effects of cannabis extracts with a focus on increased potency, solvent and pesticide residues, terpenes, solvent impurities and flavorings/fragrances.

Walter Latimer and Bruno Renda will be spoke in a Strafford live webinar, "Motor Carrier Claims for Negligent Entrustment, Hiring and Retention," on Tuesday December 3rd

Success on negligent entrustment, hiring or retention claims may result in increased compensatory damages, the potential for punitive damages, expanded discovery, and evidentiary and admissibility advantages for the victim. However, proving or defending these claims can be time consuming and expensive.

This panel guided personal injury counsel in elements of each claim, defense theory, apportioning liability and damages, impact of admission, best practices for defense counsel, and more.
